1. Acceptance of Terms

By accessing or using PQCrypta services provided by Fated LLC (“Company,” “we,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our services.

2. Service Description

PQCrypta provides post-quantum cryptography services including:

  • 28 quantum-resistant encryption algorithms
  • 166+ API endpoints for cryptographic operations
  • Key generation, encryption, decryption, and signature services
  • Security scanning and analysis tools
  • ML-enhanced compression services

3. Account Registration

To access certain features, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years of age
  • Notify us immediately of any unauthorized access

You are responsible for all activities under your account.

4. API Usage and Rate Limits

API usage is subject to:

  • Rate Limits: Enforced per account and API key
  • Fair Use: No excessive or abusive usage patterns
  • Authentication: Valid API key required for all requests
  • Monitoring: We monitor usage for security and performance

We reserve the right to suspend or terminate accounts that violate usage policies.

5. Acceptable Use

You agree NOT to:

  • Use services for illegal purposes or to violate any laws
  • Attempt to breach security or authentication measures
  • Reverse engineer or decompile our software
  • Interfere with other users’ access to services
  • Transmit malware, viruses, or harmful code
  • Engage in cryptocurrency mining using our infrastructure
  • Resell or redistribute services without authorization

6. Intellectual Property

All PQCrypta services, documentation, and related materials are protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of data you encrypt or process through our services.

Our Content: We retain all rights to our software, algorithms, APIs, and documentation.

7. Service Availability

We strive for 99.99% uptime but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with advance notice
  • Suspend service for emergency maintenance
  • Modify or discontinue features with reasonable notice

8. Pricing and Payment

For paid services:

  • Pricing available at time of purchase
  • Charges billed monthly or as specified in your plan
  • No refunds for partial months unless required by law
  • We may change pricing with 30 days notice

9. Disclaimer of Warranties

SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of results

We do not warrant that services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data breaches beyond our control

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Fated LLC from claims arising from:

  • Your use of services
  • Violation of these Terms
  • Infringement of third-party rights

12. Termination

We may suspend or terminate your account:

  • For violation of these Terms
  • For non-payment of fees
  • For fraudulent or abusive behavior
  • At our discretion with notice

You may terminate your account at any time by contacting support.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law provisions.

14. Dispute Resolution

Disputes shall be resolved through:

  1. Good faith negotiation
  2. Binding arbitration if negotiation fails
  3. Arbitration conducted under AAA rules

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or service notification. Continued use after changes constitutes acceptance.
